Building heights access request

Shallower or deeper, Montreal's subgrades are more lopsided, that's for sure...
 
Has there every been an instance of where the city of Toronto has said no to a developer who wishes to exceed the allowed height? It seems that the rules are there to be broken instead of enforced, whereas the infringments should be the exception, not the rule.
 
Perhaps developers wouldn't need to exceed the permitted heights if the zoning was reasonably current!

The zoning should then be updated to match a city plan, if there is one, and then enforced.
